The FMD (“we,” or “us”) and its operated websites and subdomains (“Sites”) take your data protection rights and our legal obligations seriously and we are committed to protecting your personal information. Subject to certain exemptions, and in some cases dependent upon the processing activity we are undertaking, if you are an EU data subject, you may have certain rights in relation to your personal information.


You have the following rights with respect to your personal data:

 

  1. Right to withdraw consent

Where applicable, you have the right to withdraw your consent at any time.   For example; you can take steps to change your preferences as listed in Section 11 of our Privacy Policy. You also are under no obligation to provide any information to us as listed in Section 2 of our Privacy Policy 'Information We May Collect & Process".  

 

  1. Right of access, rectification and erasure

You have the right to request access to and obtain a copy of any of your personal data that we may hold, to request correction of any inaccurate data relating to you and to request the deletion of your personal data under certain circumstances. You can ask to obtain a copy of, or reference to, the safeguards under which your personal information is transferred outside of the European Union and you have the right to be informed of (a) the source of your personal information; (b) the purposes, legal basis and methods of processing; (c) the data controller’s identity; and (d) the entities or categories of entities to whom your personal information may be transferred.

You have a right to request that we rectify inaccurate personal information. We may seek to verify the accuracy of the personal information before rectifying it. You can also request that we erase your personal information in limited circumstances where: (a) it is no longer needed for the purposes for which it was collected; (b) you have withdrawn your consent (where the data processing was based on consent); (c) following a successful right to object (see right to object); (d) it has been processed unlawfully; (e) to comply with a legal obligation to which ACTIVE is subject.

We are not required to comply with your request to erase personal information if the processing of your personal information is necessary for compliance with a legal obligation; or for the establishment, exercise or defense of legal claims.   1. Right of data portability

Under certain conditions, you have the right to receive all such personal data which you have provided to us in a structured, commonly used and machine-readable format, and also to require us to transmit it to another controller where this is technically feasible, but in each case only where: the processing is based on your consent or on the performance of a contract with you; and the processing is carried out by automated means.



  1. Right to restriction of processing

You have the right to restrict our processing of your personal data where:

  • you contest the accuracy of the personal data until we have taken sufficient steps to correct or verify its accuracy;
  • the processing is unlawful, but you do not want us to erase the data;
  • we no longer need your personal data for the purposes of the processing, but you require such data for the establishment, exercise or defense of legal claims; or
  • you have objected to processing justified on legitimate interest grounds (see below) pending verification as to whether we have overriding compelling legitimate grounds to continue processing.
  • Where personal data is subject to restriction in this way, we will only process it with your consent or for the establishment, exercise or defense of legal claims.

 

  1. Right to object to processing justified on legitimate interest grounds

Where we are relying upon legitimate interest to process personal data, then you have the right to object to that processing. If you object, we must stop that processing unless we can either demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms or where we need to process the data for the establishment, exercise or defense of legal claims. Where we rely upon legitimate interest as a justification for processing we believe that we can demonstrate such compelling legitimate grounds, but we will consider each case on an individual basis. 

 

  1. Right to object to how we use your personal information for direct marketing purposes

You can request that we change the manner in which we contact you for marketing purposes. You can request that we not transfer your personal information to unaffiliated third parties for the purposes of direct marketing or any other purposes.

 

  1. Right to lodge a complaint with your local supervisory authority

You also have the right to lodge a complaint with a supervisory authority if you consider that the processing of your personal data infringes applicable law.  We ask that you please attempt to resolve any issues with us first, although you have a right to contact your supervisory authority at any time.

 


If you wish to access any of the above-mentioned rights, we may ask you for additional information to confirm your identity and for security purposes, in particular before disclosing personal information to you. We reserve the right to charge a fee where permitted by law, for instance if your request is manifestly unfounded or excessive.
