DMCA & Content Policy on FMD

The following Copyright Agreement ("Agreement") governs the use of the Fashion Model Directory online service (following named "Fashion Model Directory") available on www.fashionmodeldirectory.com and related domains as provided by Fashion Model Directory ("Service Provider").
Please read the rules contained in this Agreement carefully. You can access this Agreement any time at http://www.fashionmodeldirectory.com/info/dmca/.


PREAMBLE

Your use of and/or registration on any aspect of the Service will constitute your agreement to comply with these rules. If you cannot agree with these rules, please do not use and leave the Service. These rules may be modified from time to time; the date of the most recent revisions will appear on this page. Continued access of the Service by you will constitute your acceptance of any changes or revisions to the Agreement. Your failure to follow these rules, whether listed below or in bulletins posted at various points in the Service, may result in suspension or termination of your access to the Service, without notice, in addition to Service Provider's other remedies



§ 1.0 INTELLECTUAL PROPERTY / COPYRIGHT

All material shown on the Fashion Model Directory website including, but not limited to images, databases, information, designs and video clips is protected by copyrights owned or controlled by the Fashion Model Directory or its Partners. UNAUTHORIZED COPYING, REPRODUCTION, REPUBLISHING, UPLOADING, DOWNLOADING, POSTING, TRANSMITTING OR DUPLICATING OF ANY OF THIS MATERIAL, IN WHOLE OR IN PART, IS PROHIBITED. Any unauthorized use may subject the offender to civil liability and criminal prosecution under applicable federal and state law.
This doesn't apply to 3rd party material (read §2.0).



§ 2.0 THIRD PARTY COPYRIGHT

Material provided by any 3rd party, including material obtained through links to other sites from the Fashion Model Directory, is likely to be the copyright material of the author. In such cases permission to copy or otherwise use such material should be sought from the author.
The Fashion Model Directory respects the intellectual property of others, and we ask our users to do the same.
All 3rd party images on this site are for personal viewing purposes only and remain the copyright of their respective owners. The images may not be re-used for commercial purposes. They are used here under the “fair use” provisions of Section 107 of the U.S. Copyright Act. Every effort has been made to credit the photographer, source or copyright holder.

If you believe that your work has been copied and is accessible on the Fashion Model Directory in a way that constitutes copyright infringement, or that the Fashion Model Directory contains links or other references to another online location that contains material or activity that infringes your copyright rights, you may notify us by providing the following information (as required by the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act, 17 U.S.Copyright Section 512) to our Copyright Contacts set forth below.

  • 1. A physical or electronic signature of person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
  • 2. Identification in sufficient detail of the copyrighted work claimed to have been infringed, or other information sufficient to specify the copyrighted work being infringed);
  • 3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Fashion Model Directory to locate the material;
  • 4. Information reasonably sufficient to permit Fashion Model Directory to contact the complaining party, such as an address, telephone number, and if available, an electronic mail address at which the complaining party may be contacted;
  • 5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law. Include the following statement: "I have a good faith belief that use of the copyrighted materials described above as allegedly infringing is not authorized by the copyright owner, its agent, or the law.";
  • 6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Include the following statement: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.";
  • 7. Sign the email with your name.;

§ 3.0 Requests For Further Information

To ensure a timely processing of your notice or counter-notice, please make sure you have complied with the steps set forth above. If we request additional information required to make your DMCA notice complete, please provide that information promptly. If you fail to comply with these requirements, we may not be able to process your notice or counter-notice.



§ 4.0 Bad Faith Conduct

There are potentially serious consequences to filing DMCA notices, particularly inaccurate ones. Obtain your own legal advice as necessary. Do not make false claims, as these could result in penalties for legal damages. Under 17 U.S.C. § 512(f) of the DMCA anyone who knowingly makes materially false claims in a takedown notice shall be liable for damages, including costs and attorneys’ fees incurred by the alleged infringer, copyright owner, or service provider injured by such misrepresentation or reliance upon such misrepresentation in removing or disabling access to the contended infringing material.



§ 5.0 Disclosure of DMCA notices

Please note that a copy of each legal notice we receive may be sent to the Lumen Database (formerly known as Chilling Effects project) for publication and annotation. The Lumen Database is a joint project among law schools in the United States that seeks to provide a database for and information on requests to remove information from the Internet. The Lumen Database will redact the submitter's personal contact information (i.e. phone number, e-mail and address).
